Introduction

Traboda CyberLabs Private Limited (“us”, “we”, or “our”) operates traboda.com (hereinafter referred to as “Service” or ”Platform). This is our Privacy Policy that governs our Platform and applies to you when you visit traboda.com, and we shall explain to you how we collect, why we collect, how we use, safeguard and disclose any information that is associated with you from your usage of our Platform.

Our Terms of Service (”Terms”) govern all use of our Platform and together with this Privacy Policy constitutes your agreement with us (”Agreement”). By using our Platform, you agree to the collection and use of information in accordance with this Agreement.

Collection of Information

We collect several different types of information for various purposes to provide and improve our Service to you.

A User's Personal Data, Activity Data, Usage Data and any other Data mentioned below, that are collected, stored, processed, transferred or maintained by us as laid out by this Agreement shall be hereinafter together referred to as ”Account Data”.

Personally Identifiable Information (PII)

While using our Service, we may ask you to provide us with certain personally identifiable information (“Personal Data”) that can be used to contact or identify you.

We collect and store your personally identifiable data only when you choose to create an account on the Platform.

However, to enforce our Terms with Users of the Platform, we may also track and log all visits and usage of our Platform, including during anonymous usage, which may include collection of the following personal information without you providing it explicitly, or creating an account with us -

  1. Internet Protocol (IP) address
  2. Browser Name & Version
  3. Operating System Name & Version
  4. Device Name & Model
  5. Usage Data - Pages Visited, Visit Timestamps, & Duration of Visits

We may also collect and store some very limited personally identifiable data which we gain access or collect from third-party providers on the basis of our agreement with them. We require these providers to mention this information disclosure to us in their respective privacy policy.

These information include -

  2. Full Name

The following information is compulsorily collected from you when you decide to create an account on Traboda -

  1. Full Name
  2. Email
  3. Country

You may also decide to provide us additional information about yourself, by editing your User profile on our Platform. Some of these information shall be made public on your User profile page on our Platform, but you shall be able to use our platform without needing to provide these information to us. These additional Personal Data include -

  1. User Avatar Photo
  2. Gender
  3. Date of Birth
  4. City & State
  5. Educational & Professional Information
  6. Biodata text
  7. Links to your profiles on other third-party platforms

We do not store previous versions, backups or logs of any of the Personal Data you provide us, once you have updated or nullified them, and only store, process and use only the latest version provided to us.

During your day to day use of our Platform, you may also provide us some limited Personal Data in other forms such as, but not limited to, -

  1. Posts/Comments posted in discussion forums in the platform
  2. Challenge Description, Hints, Write-ups
  3. Contest Information - Cover Image, Description, Contact information etc.

Usage Data

We may also collect information that your browser sends whenever you visit our Service or when you access Service by or through a mobile device (”Usage Data”).

This Usage Data may include information such as your device's Internet Protocol (IP) address, operating system & version, browser name, type & version, device name & model, the pages of our Service that you visit, the timestamp of your visit, the time spent on those pages, and other diagnostic data.

Payment

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

We use Razorpay for processing payments. We/Razorpay do not store your card data on their servers. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) when processing payment. Your purchase transaction data is only used as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is not saved.

Our payment gateway adheres to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Usage of Information

We uses the various data collected from you for different purpose, which can be broadly listed out as following -

  1. To provide & maintain our Service
  2. To notify you about changes to our Service
  3. To allow you to participate in interactive features of our Service when you choose to do so
  4. To provide customer support
  5. To gather analysis or valuable information to improve our Service
  6. To monitor the usage of our Service
  7. To detect, prevent and address technical issues & fraudulent activities on our Platform
  8. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection
  9. To provide you with notices about your account and/or subscriptions, including expiration and renewal notices, email instructions etc.
  10. To provide you with news, promotions and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information

Emailers

Promotional Emails

We may use your email address to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving these promotional communications from us by following the using the unsubscribe link provided at the bottom of the emails, or from the settings page on our Platform.

Notification Emails

We may use your email address to notify you the following -

  1. important announcements, policy changes, security breaches
  2. password changes and suspicious activities detected on your account
  3. notifying you have violated our Agreement, or when your account is banned

You cannot opt out of these emailers while you continue to use our Platform. We shall stop sending you these emails only when you either deactivate or delete your account.

You shall also receive the following notification emails -

  1. invite you received for joining a team or contest
  2. about release of new content in a category you have subscribed
  3. updates about a contest you are organizing or participating in
  4. nonthly progress-cards, congratulatory messages
  5. Mails to ask you feedback, follow up on issues you have reported to us

Disclosure of Information

We may employ third party companies and individuals to facilitate our Service (”Service Providers”), provide Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

Payment & Third-Party Services

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Legal Disclosures

We will not disclose your Personal Information unless we're required to do so to comply with the law or a binding order of a government body. If a governmental body sends us a demand for Account Data, we will attempt to redirect the governmental body to request that data directly from the User.

If compelled to disclose Account Data to a government body, we will give customers reasonable notice of the demand to allow the customer to seek a protective order or other appropriate remedy unless we are legally prohibited from doing so.

Governmental and regulatory bodies need to follow the applicable legal process to obtain valid and binding orders. We review all orders and object to overbroad or otherwise inappropriate ones. Unless prohibited from doing so, we shall notify Users before disclosing their Account Data so they can seek protection from disclosure.

Business Transactions

If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We shall inform you about such transactions in advance, and you may request to delete your account to avoid such a transfer.

Other Disclosures

We may disclose your information also:

  1. to our subsidiaries and affiliates
  2. to contractors, service providers, and other third parties we use to support our business
  3. to fulfill the purpose for which you provide it
  4. for the purpose of including your user avatar or company’s logo on our website with your consent in any other cases;
  5. if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Platform, our Users, or others.

Retention of Information

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy.

We will erase any Personal Data we have with us when you decide to delete your Account on our Platform. However, we may retain some Personal Data about you for short period of time, upto 6 months, to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain all your Personal Data when your account is banned or inactive for upto 2 years or until any pending dispute with you are not resolved.

We will also retain any Usage Data & Activity Data for indefinite period for time for any purpose. These data may be used including for, but not limited to, internal audit purposes, strengthen the security, facilitate and improve the functionality of our Service etc.

If your Personal Data is removed from our Platform, we shall reserve the rights to continue retaining and using your Activity Data & Usage Data in a way that is completely unlinked/disassociated with your Personal Data in an anonymized form.

Please note that due to the transparent nature of our products, services, and community, we may retain limited personally-identifiable information indefinitely in order to ensure transactional integrity and nonrepudiation. However, this data will not shared or used for any other purpose.

Storage of Information

Your information, including Personal Data, may be stored, processed and transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

Currently, we host, store and process all our databases & services on the Amazon AWS Cloud & Google GCP in their Mumbai, India datacenter. We may also temporarily process and maintain some of these information on our independent systems, and servers that are based in India, from time to time in accordance with this Agreement with you.

Our employees, contractors and affiliated organizations that access or process any Personal Data for us as described above may be located in the India or in other countries outside of your home country; by using the Platform, you consent to the international transfer of your information by Traboda.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

Security of Information

We understand that the security of your Personal Data is important to you. When handling Personal Data, we understand your security is paramount and we seek to ensure that Personal Data is adequately protected.

We use reasonable administrative, logical and physical controls, including password protection, to safeguard your personal information against loss, theft and unauthorized access, use or modification. We use industry standard measures to protect the personal information that is stored in our database. However, we do not guarantee the security of the databases due to the fact that despite adopting various effective security measures, no security system is impenetrable or inaccessible.

We limit the access to your Personal to those employees and contractors who need access to perform their job function, such as our customer service personnel. Further, any sort of personal information shared by the user through their profile, discussion forums, comments or reviews over the platform is publicly accessible.

In addition to this, the user information can be obstructed amid the transfer of the information over the internet. You hereby acknowledge that we are not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.

Do Not Sell My Personal Data

We do not sell any of your Account Data for monetary consideration. However, a transfer of Personal Data to a third party service provider, or within our family of companies, without monetary consideration may be considered a “sale” under some laws such as California Privacy Protection Act (CalOPPA).

You may request to stop transferring your Personal Data to a third-party service provider, or our family of companies or affiliates, by requesting us through mail at [email protected],

If you make this request, we will shall not transfer in any way to any party any Personal Data we hold about you as of the date of your request, and also direct all of our service providers to do delete any Account Data they may have about you. In some cases, these deletion may be accomplished through de-identification of the information.

If you wish to delete all your Personal Data, including from us, you may need to delete your account from our Settings, and therefore will not be able to use certain functions that require login to operate.

Please note if you request us to stop transfer of your Account Data to our service providers, affiliates and family of companies, it may impact your experience with us, and you may not be able to participate in certain programs or memberships services which require such transfers. But in no circumstances, we will discriminate against you for exercising your rights.

Do Not Track Signals

Do Not Track is a privacy preference you can set in your browser if you do not want online services to collect and share certain kinds of information about your online activity from third party tracking services.

Traboda does not track your online browsing activity on other online services over time and we do not permit third-party services to track your activity on our site beyond our basic tracking, which you may opt out of. Because we do not share this kind of data with third party services or permit this kind of third party data collection for any of our users, and we do not track our users on third-party websites ourselves, we do not need to respond differently to an individual browser's Do Not Track setting.

Applicable Law & Jurisdiction

By visiting this Platform, you agree that the laws of the Republic of India without regard to its conflict of laws principles, govern this Privacy Policy and any dispute arising in respect hereof shall be subject to and governed by the dispute resolution process set out in the Terms of Service.

Amendments

Although most changes are likely to be minor, we may change its privacy policy from time to time, and in Traboda's sole discretion, to reflect the changes in our business and practices, and so you should review this page periodically. We will let you know changes by updating this page with the new policy, updating the ”Effective date” at the top of this page.

If we decide to make a significant change, we shall let you know via email and/or a prominent notice on our platform, prior to the change becoming effective.

We will not make any material changes to our Privacy Policy that relate to the collection or use of Personal Data of Users without first giving notice to the User and and providing a choice to opt-out before the Personal Data are used in a materially different manner than was disclosed when the information was collected.

Changes to this Privacy Policy are effective when they are posted on this page. Continued use of the platform after any change/amendment to this Privacy Policy shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

We shall also publicly maintain all previous versions of our Privacy Policy, and provide links to it at the bottom of this Privacy Policy document.
